Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of KnowFlow ("Service"), operated by PATHAKHRK INC ("we", "us", "our"). By installing KnowFlow from the Shopify App Store, you ("Merchant") agree to be bound by these Terms.

2. Description of Service

KnowFlow is a Shopify application that automatically sends post-purchase educational email sequences to your customers after their orders are fulfilled. The Service includes:

• Automated email drip sequence creation and delivery
• Flow builder and template library
• Analytics dashboard showing email engagement and return rate impact
• WhatsApp integration (where available)
• AI content generation tools

3. Shopify Partner Agreement

KnowFlow is built on the Shopify platform. Your use of the Service is also subject to Shopify's Terms of Service and Partner Program Agreement. In the event of a conflict, Shopify's terms govern with respect to the Shopify platform itself.

4. Merchant Responsibilities

As a merchant using KnowFlow, you agree to:

• Only send emails to customers who have placed legitimate orders in your Shopify store
• Comply with all applicable email marketing laws including CAN-SPAM, GDPR, CASL, and any other laws applicable in your jurisdiction
• Not use the Service to send spam, unsolicited emails, or misleading content
• Provide accurate sender information (name and email domain)
• Honor customer opt-out/unsubscribe requests promptly
• Ensure your email content does not violate intellectual property rights
• Not use the Service for any unlawful purpose

5. Billing and Payments

• KnowFlow uses Shopify's billing system for all subscription charges
• Charges are billed monthly through your Shopify account
• The Free plan is available at no cost subject to usage limits
• Paid plans are charged at the start of each billing cycle
• You may cancel your subscription at any time from within the app or Shopify admin
• Refunds are handled on a case-by-case basis — contact us at info@pathakhrk.com
• We reserve the right to change pricing with 30 days notice to active subscribers

6. Data and Privacy

Your use of customer data through KnowFlow is governed by our Privacy Policy. You are the Data Controller for your customers' data. KnowFlow acts as a Data Processor on your behalf. You are responsible for ensuring you have the lawful basis to send post-purchase communications to your customers.

7. Intellectual Property

• KnowFlow and all associated code, design, and content are owned by PATHAKHRK INC
• You retain ownership of all email content and templates you create in the app
• You grant KnowFlow a limited license to store and process your content solely to provide the Service
• AI-generated content belongs to you once generated

8. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We are not liable for losses caused by downtime, delayed emails, or service interruptions. We will notify merchants of planned maintenance in advance where possible.

9. Limitation of Liability

To the maximum extent permitted by law, KnowFlow and PATHAKHRK INC shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to lost revenue, lost profits, or loss of data arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 30 days prior to the claim.

10. Indemnification

You agree to indemnify and hold harmless KnowFlow and PATHAKHRK INC from any claims, damages, or expenses arising from your misuse of the Service, violation of these Terms, or violation of any third-party rights.

11. Termination

• You may terminate your use of KnowFlow at any time by uninstalling it from your Shopify store
• We may suspend or terminate accounts that violate these Terms without prior notice
• Upon termination, your data will be deleted per the Privacy Policy retention schedule

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice at least 30 days before they take effect. Continued use after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved through good-faith negotiation first, followed by binding arbitration if necessary.
